Definitions
This Terms and Conditions document is a legal agreement between ITLogin Kashmir, hereafter referred to as "ITLogin," and "the Client" for website design, development, and other services provided by ITLogin. These Terms and Conditions outline the provisions under which the Client may use the services supplied.
Services Provided
ITLogin offers website design, graphical design, HTML, CSS, Javascript, PHP, and other related computer programming languages. ITLogin also provides print designs, corporate branding, social media promotions, and mobile app development.
Permission and Copyright
Upon final payment, the copyright of completed designs, images, pages, code, and source files created by ITLogin for the project shall belong to the Client, unless otherwise agreed in writing. Without such an agreement, ownership remains with ITLogin.
The Client is granted a non-exclusive, limited license to use the design on one website on one domain name only. Resale or distribution of the completed files is not permitted without prior written agreement with ITLogin.
The Client guarantees that all media and content provided to ITLogin are either owned by the Client or used with full permission. The Client agrees to hold harmless and defend ITLogin from any claims arising from the use of supplied media and content.
ITLogin reserves the right to include development credits and links within the code and display them on the Client’s website. ITLogin may also include any work done for the Client in its portfolio.
Initial Work
ITLogin will commence the project upon receiving the required materials from the Client. The home page or mock-up design will typically be shown within five working days, subject to change based on Client requirements. The Client must provide a clear idea of the design/theme/colour and all aspects of the project during preliminary discussions.
Content Clauses
The project will commence within 24 hours after receiving the advance payment from the Client. The Client must provide the content within seven days from the project start date. A 5% additional charge will apply if content is not provided within this period. The Client will have an additional ten days to provide the content after paying the extra charge. If the content is not provided within the extended time, the project will be considered invalid, and the payment will not be refundable.
Alteration Work
Alterations must be informed within three days after the initial work submission. ITLogin will not undertake further work unless confirmed by the Client within this period.
Redesign Clauses
Changes requested after the completion and approval of the project will be considered a redesign and will be chargeable. Errors in content or design identified by the Client will be rectified immediately. The project will be uploaded and made live after the final approval and settlement of the balance amount by the Client.
Free Maintenance
ITLogin provides one year of free maintenance for runtime errors on the website/application/project. Free maintenance does not include content updates.
Quotation Validity
Quotations are valid for seven days. Prices are subject to change without notice after the expiration of the quotation.
Material Rights
ITLogin reserves the right to refuse to handle:
- Unlawful or inappropriate media
- Media containing viruses or hostile programs
- Media constituting harassment, racism, violence, obscenity, harmful intent, or spamming
- Media constituting a criminal offense or infringing privacy or copyright
Refund Policy
The Refund Policy defines situations under which ITLogin will provide a refund, the procedure for claiming a refund, and ITLogin’s responsibilities in such circumstances. By registering for our services, you agree to the terms outlined in the Refund Policy.
Coverage & Scope
Our refund policy covers refunds by ITLogin Kashmir. It does not apply to companies not owned or controlled by ITLogin or to persons not employed or managed by ITLogin.
Filing a Complaint
ITLogin aims to resolve any service dissatisfaction amicably. Refunds are considered only when a solution cannot be reached.
Eligibility for Refund
Website/Mobile Applications Development
- Full refund: If the project has not started or if the initial design is not approved.
- Partial refund: If delivery fails as per the approved initial design. The refund will be proportional to the work completed.
- No refunds: If the project is completed and uploaded on the server.
Logo/Brochure Design
- Full refund: If the project has not started or if the initial design is not approved.
- Partial refund: If delivery fails as per the approved initial design. The refund will be proportional to the work completed.
- No refunds: If the project is completed and uploaded on the server.
Web Programming
- Full refund: If the project has not been initiated.
- Partial refund: If delivery fails as per the agreed terms. The refund will be proportional to the work completed.
Processing of Refunds
Partial refunds will be processed within 90 business days of cancellation. Full refunds will be processed within 45 business days of cancellation. Refunds will be issued using the original payment method.
Changes
ITLogin may amend this policy at any time without prior notice. Continued use of ITLogin’s services implies acceptance of the changes.
